2. Our Products
We design and supply products supporting scalp and hair care before and after surgical hair restoration. Product details, images, and pricing are provided in good faith but minor variations may occur.
Product lifecycle:
- Phase 1 – Pre-Surgery Shampoo (Cosmetic product, before surgery)
- Phase 2 – Modyu Cleanse (Class IIa sterile medical device, 0–3 days post-surgery)
- Phases 3 & 4 – Post-care / Maintenance products (Cosmetic products, after 3 days)
3. Ordering
An order becomes binding once payment is processed and you receive confirmation. We may cancel orders if items are out of stock or payment fails.
4. Prices and Payment
All prices are in pounds sterling (£) and include VAT where applicable. Delivery charges appear at checkout. Payment must be made in full at the time of order.
5. Delivery
We currently deliver within the United Kingdom only. Delivery times are estimates and may vary due to factors beyond our control. Responsibility for the goods passes to you upon delivery.
6. Returns & Refunds
You have a 14-day statutory right to cancel most online purchases, provided the item remains sealed. Modyu also offers a 28-day return policy for unopened items in their original packaging. Customers are responsible for the cost of return postage unless the item is faulty or sent in error. Opened or unsealed cosmetic products cannot be returned for hygiene reasons unless faulty.
Hygiene Seal: All Modyu products are supplied in sealed packaging. The “seal” refers to the tear-off security seal on the product box or sterile pouch. Once this seal is broken, the product cannot be returned unless faulty or misdescribed.
7. Faulty or Damaged Products
If your order arrives damaged, faulty, or not as described, contact us at contactus@modyu.com. You are entitled to a repair, replacement, or refund under the Consumer Rights Act 2015.
8. Product Categories and Regulatory Information
Modyu manufactures and supplies both cosmetic products and medical devices: • Cosmetic products (Phases 1, 3 & 4) – regulated under the UK Cosmetic Products Regulation (EC 1223/2009 as retained in UK law).
• Phase 2 – Modyu Cleanse – Class IIa sterile medical device regulated under the UK Medical Devices Regulations 2002 (as amended). • The device carries the appropriate UKCA/CE mark and has undergone conformity assessment.
• Modyu Ltd acts as both Manufacturer and UK Responsible Person for the device.
Intended Use:
Phase 1 – Pre-Surgery
Shampoo: cosmetic cleanser before surgery.
Phase 2 – Modyu Cleanse: sterile wound-cleansing medical device for topical use (0–3 days post-surgery).
Phases 3 & 4 – cosmetic formulations for scalp and hair maintenance once the skin barrier has recovered.
Use & Supervision: Follow all Instructions for Use (IFU) and professional guidance. Do not reuse or re-sterilise single-use devices. Store as directed.
Adverse Incidents: If an adverse reaction occurs, stop using the product and seek medical advice. Report incidents to contactus@modyu.com so we can meet MHRA post-market surveillance obligations.
Limitations of Liability (Medical Devices): Modyu Ltd is not liable for losses arising from misuse, off-label use, or use beyond intended indication. Nothing in these Terms excludes liability for death or injury due to negligence, fraud, or any liability that cannot be excluded under UK law.
Disclaimer: Phases 1, 3 & 4 are cosmetic and not intended to diagnose, treat, cure, or prevent disease.
Phase 2 (Modyu Cleanse) is a Class IIa medical device; use only as directed in the IFU and by your healthcare professional.
9. Your Personal Data
Your personal data is handled in accordance with our Privacy Policy and Cookie Policy. By ordering from us, you consent to the use of your data to process and deliver your purchase.
10. Liability (General)
We are responsible for foreseeable loss or damage caused by negligence or breach. We are not liable for unforeseeable losses or business losses. Your statutory rights are not affected.
11. Intellectual Property
All content, text, images, trademarks, and designs are owned by or licensed to Modyu Ltd. You may not copy or reuse any content without prior written consent.
12. Events Beyond Our Control
We are not liable for delays or failures caused by events beyond our reasonable control, such as natural disasters, courier delays, or supplier issues.
13. Changes to These Terms
We may update these Terms occasionally to reflect changes in law or business practices. The version published on our website at the time of purchase applies to that order.
14. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the English courts.
Regulatory Footnote
Modyu Phase 2 Cleanse is a Class IIa medical device regulated by the MHRA. Always follow your clinician’s instructions and the product IFU. All other Modyu products are regulated as cosmetic products under UK law.
